Distance Sales Agreement

1. Parties

Buyer: the person who orders on eathub.online by scanning the QR code in a hotel room. The Buyer's delivery address is the hotel and room number the order is placed from.

2. Subject

This agreement sets out the rights and obligations of the parties regarding the sale and delivery of the food and drinks the Buyer orders electronically on the Seller's order screen at eathub.online, under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

3. Products and price

The name, quantity and options of the products, unit prices, discounts, delivery fee and the total including taxes appear in the order summary shown to the Buyer at the payment step and are kept with the order record. This order summary forms an integral part of this agreement.

4. Formation of the agreement

The agreement is formed when the Buyer accepts the Pre-Information Form and this agreement and completes payment. An order whose payment is not completed is not passed to the Seller, and no agreement is formed.

5. Payment

The price is paid in advance by card at the time of ordering through a licensed payment institution. The Seller has no access to card details.

6. Delivery

  • The products are delivered to the hotel room the order is placed from or, where the hotel's rules require, to the reception.
  • The estimated delivery time is shown when ordering and can be followed on the order screen. It may be longer at busy times or in bad weather; the Buyer is informed of long delays.
  • The Seller must deliver within 30 days at the latest; ready-meal orders, however, are delivered on the same day within the time shown on the order screen.

7. Right of withdrawal

As the products are food and drinks that deteriorate quickly and are prepared on the Buyer's order, there is no right of withdrawal under Article 15 of the Distance Contracts Regulation. Cancellation before preparation, and orders that cannot be delivered or are incomplete or wrong, are governed by the Cancellation and Refund Terms.

8. Obligations of the parties

  • The Seller must prepare and deliver the products as ordered, safely and in line with hygiene rules.
  • The Buyer must make sure the order is placed from the right room and be reachable at delivery. Allergies and special requests should be stated in the order note.
  • Alcoholic drinks are sold only to persons aged 18 or over; the Seller may ask for ID at delivery.

9. Personal data

The Buyer's personal data is processed in line with the Privacy Policy and Personal Data Notice.

10. Disputes

Disputes arising from this agreement are heard by the Consumer Arbitration Committees within the monetary limits set each year by the Ministry of Trade, and by the Consumer Courts above those limits.

11. Entry into force

By ticking the box at the payment step, the Buyer declares having read and accepted all terms of this agreement. The agreement enters into force when the order is paid; the time of acceptance and the order content are kept by the Seller.
